Copyright and DMCA Policy

Everpay respects intellectual property rights and expects its merchants and users to do the same. This policy explains how to report content you believe infringes your copyright and how users can respond.

    Last updated

If you believe content hosted on or linked from an Everpay-operated service, including a merchant's hosted checkout page, payment link or uploaded file, infringes your copyright, send a written notice that includes all of the following (17 U.S.C. 512(c)(3)):

    1. Your physical or electronic signature, or that of a person authorized to act on behalf of the copyright owner.
    2. Identification of the copyrighted work you claim has been infringed.
    3. Identification of the material you claim is infringing, with enough detail (such as a URL) for us to locate it.
    4. Your name, postal address, telephone number and email address.
    5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
    6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Send notices to hello@everpayinc.com with the subject line "Copyright Notice", or by post to Everpay Corporation, 4711 Yonge Street, 10th Floor, Toronto, ON M2N 6K8, Canada. Please note that knowingly misrepresenting that material is infringing can create legal liability.

What we do with a valid notice

    • We review the notice and, where it is complete, remove or disable access to the material.
    • We notify the affected merchant or user and give them the opportunity to respond.
    • We may share the notice with the person who provided the material.

    Counter-notices

If you believe material was removed by mistake or misidentification, you may send a counter-notice that includes your signature, identification of the removed material and its former location, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake, your name, address and phone number, and consent to the jurisdiction of the federal court for your address. If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless the original complainant tells us they have filed a court action.

    Repeat infringers

In appropriate circumstances we terminate the accounts of merchants or users who are repeat infringers.

    Trademarks and other claims
